As Variety reports, the civil complaint filed in a Los Angeles court on December 31, 2025, details a series of events that Joseph claims began shortly after he was hired in November 2024. According to the lawsuit, Smith was accused of “predatory behavior” and as they began spending more time alone ahead of the ‘Based on a True Story 2025’ tour, Smith began “grooming” Joseph for further sexual abuse. Joseph alleges that Smith once told him, “You and I have a special relationship that I don’t have with anyone else.”

The situation reached its peak during the Tour in Las Vegas in March 2025. Joseph claims that when he returned to his hotel room, which had been booked by Smith’s company, he found that an unknown person had entered. Inside, they reportedly found a sexual message, wipes, a beer bottle and hospital discharge papers. Most disturbingly, the lawsuit also mentions the discovery of HIV medication with someone else’s name on it and a handwritten note that read: “Brian, I’ll be back by 5:30, just the two of us (heart drawn), Stone F.”
Horrified by the scene, Joseph reported the incident to hotel security, tour management and the non-emergency police line. However, instead of receiving support, Joseph alleges that the management “shamed” him and accused him of lying. After a few days he was fired from his job. While the team told him the tour was simply “going in a different direction,” Joseph reported that another violinist was immediately hired, leading him to believe the firing was an “excuse.”
On his Instagram story, Joseph also thanked well-wishers for their support. Joseph is now suing for sexual harassment, wrongful termination and retaliation, saying the incident caused him PTSD and significant financial loss. Will Smith’s representatives have not yet responded to these allegations.
